Terms and Conditions

General

The following terms and conditions together with specific terms and conditions set out in any accompanying document shall, unless otherwise agreed in writing by PremiumArt.co.uk, apply to and govern any agreement for the sale or other supply of goods or services by PremiumArt.co.uk, and any quotations and acknowledgement or acceptance of order issued by PremiumArt.co.uk, to the exclusion of any other terms and conditions whether express or implied. Where these conditions conflict with the purchaser’s terms and conditions of purchase, these conditions shall prevail.

Payment

§           European customers can pay by credit card, Paypal, or bank transfer.

§           Delivery will only occur after full payment has been received and cleared.

§           Payment includes shipping, packaging, delivery insurance, and VAT on UK sales

§           Payments are only accepted in pound sterling.

Availability

§           All artwork is subject to availability and is sold on a first come first served basis.

§           In the unlikely event that a painting becomes unavailable after the purchase process has been completed, the unsuccessful buyer will be informed by email and a full refund will be issued.

§           The seller reserves the right to cancel any order. Should this occur a full refund would be issued.

Prices

§           All prices are including VAT and excluding delivery costs.

§           The price and description of the artwork is valid at the time of order. Any subsequent changes will not affect the order. 

Delivery

§           Delivery is the responsibility of the seller. The seller meets all delivery and insurance costs.

§           The artwork will be delivered to the address submitted by the buyer on the order form in the website.

§           Once delivered, the buyer will be the owner of the artwork and therefore responsible for any loss or damage.

§           A buyer must refuse to take delivery of the artwork if damage is evident on arrival.

§           If a buyer refuses to take delivery of the artwork for any reason other than evident damage, then expenses incurred by the seller for delivery and return of the item will be deducted from any refund.

§           The maximum delivery time is 30days. In the event that the maximum time is exceeded PremiumArt.co.uk will contact the buyer.

o         Buyers not trading as a commercial concern will have the option to cancel with full refund. Refunds will be paid within 14days of receiving official written confirmation (email acceptable), of order cancellation.

o         For buyers trading as a commercial concern, the maximum delivery time is not legally binding. Therefore exceeding this maximum will not be counted as a shortcoming on the seller’s behalf.

Cancellations / Returns

§           The buyer may return the painting within 7 working days of delivery. If an order is cancelled the buyer must notify the seller of their intention to cancel by email or in writing, within the 7-day period and must also return the artwork to the seller within 14 days of delivery

§           The buyer is responsible for return deliveries, including all delivery and insurance costs.

§           Buyers must return the artwork to the seller in perfect saleable condition.

§           Buyers must return items in their original condition in order to obtain a refund.

§           Refund will only be made once the items have been checked & determined to be in their original and re sellable condition by the seller. Once confirmed to be in original state, refunds will be made within 14days.

Damaged Goods / Insurance Claims

§           If there is any noticeable damage to the packaging on arrival the buyer must refuse to accept the item.

§           If, on unwrapping the item, damage is discovered, the buyer must notify the seller within 24hours of receipt (or first thing Monday if a weekend delivery) of any damage to the item.

§           The buyer must send damaged items back to the seller using the sellers approved courier, details will be given on request.

§           The buyer must include the original packaging materials with the artwork when returning any damaged goods.

Copyright

§           The copyright for all paintings remains with the artist; the buyer is purchasing the original NOT the right to produce prints for publication. If publication rights are required the buyer should email the seller for prices and terms and the seller will make the required arrangements with the artist in question.

Privacy

§           Your personal details including email address, will not be sold to, or given to 3rd parties.

§           We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

§           We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

§           We will not e-mail you in the future unless you have given us your consent.  

§           We will give you the chance to refuse any marketing email from us or from another trader in the future.  

§           The type of information we will collect about you includes:  

o         your name

o         address

o         phone number

o         email address

o         credit/debit card details 

§           We will never collect sensitive information about you without your explicit consent.   

§           The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.  

§           The personal information which we hold will be held securely in accordance with our internal security policy and the law.  

§           If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.  

§           We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

Miscellaneous

§           The seller reserves the right to amend these Terms and Conditions at any time.

§           These Terms and Conditions do not affect consumer statutory rights.

§           All care and attention is taken to ensure full accuracy in documenting product size and colour, however small deviations may occur.
